These Terms of Service ("Terms") govern your use of the 360Epoxy website, services, and SMS messaging program. By accessing our website, submitting your information through our forms, or opting in to receive SMS messages, you agree to be bound by these Terms and our Privacy Policy.
1. Acceptance of Terms
By accessing and using this website, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these Terms, you should not use our website, submit any personal information, or opt in to receive SMS messages from 360Epoxy.
2. SMS Messaging Program Description
360Epoxy operates an SMS (Short Message Service) text messaging program to communicate with customers and prospective customers who have explicitly opted in through our website forms. Our messaging program name is "360Epoxy Alerts" and is operated by 360Epoxy, located in Utah, United States.
Our SMS program consists of two distinct messaging categories, each requiring separate opt-in consent:
Transactional SMS Messages (separate opt-in required):
Service-related messages tied directly to your project inquiry and account activity, including:
Appointment confirmations and reminders
Project estimate follow-ups and delivery notifications
Scheduling updates, changes, and cancellations
Project status notifications and milestone updates
Service completion confirmations
Account and billing notifications
Marketing & Promotional SMS Messages (separate opt-in required):
Promotional messages about our products, services, and offers, including:
Seasonal promotions and limited-time offers
Special discounts and exclusive deals

Each category of SMS messaging requires its own explicit opt-in via a separate, unchecked checkbox on our website form. Neither checkbox is pre-selected. Opting in to either or both categories is entirely voluntary and is not a condition of purchasing any goods or services from 360Epoxy.
3. How to Opt Out of SMS Messages
You may opt out of receiving SMS text messages from 360Epoxy at any time using any of the following methods:

After sending any of these keywords, you will receive a single confirmation message stating that you have been unsubscribed. No further messages will be sent unless you re-enroll.
Opt Out by Phone: Call 385-558-3495 during business hours and request to be removed from our SMS messaging list.
Opt Out by Email: Send an email to 360epoxyaz@gmail.com with the subject line "UNSUBSCRIBE SMS" and include the phone number you wish to remove.
If you wish to re-enroll in our SMS program after opting out, you may do so by submitting a new form on our website and checking the appropriate consent checkboxes.

5. Message & Data Rates Disclosure
Message and data rates may apply. Standard text messaging and data charges from your wireless carrier may apply to all SMS messages sent to and received from 360Epoxy. These charges are determined solely by your mobile carrier and wireless plan, and 360Epoxy has no control over and is not responsible for any messaging or data fees you may incur. Contact your wireless carrier for specific details about your messaging plan and any associated costs.
Message frequency may vary. The number of messages you receive depends on the category you opted into:
Transactional messages: Sent as needed based on your project activity and interactions with 360Epoxy. Frequency varies depending on the stage and status of your project.
Marketing messages: Sent periodically, with a maximum of approximately 4 messages per month.
You can stop all messages at any time by texting STOP to any message.
6. Carrier Liability Disclaimer
360Epoxy and all participating mobile carriers, including but not limited to AT&T, T-Mobile, Verizon, US Cellular, Sprint, and all other wireless carriers, are not liable for any of the following:
Delayed or late delivery of SMS messages
Undelivered or failed messages
Misdirected messages
Inaccurate message content caused by technical failures
Messages sent or received after an opt-out request has been processed
Any costs incurred as a result of receiving messages from 360Epoxy
Message delivery is subject to effective transmission by your mobile carrier and is affected by network conditions, device compatibility, carrier policies, and other factors outside of 360Epoxy's control. 360Epoxy makes no warranties or guarantees regarding the timeliness, completeness, or successful delivery of any SMS message.
Mobile carriers are not responsible for the content of any messages sent by 360Epoxy. Any questions or concerns about message content should be directed to 360Epoxy at 385-558-3495 or 360epoxyaz@gmail.com.
Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, US Cellular, Sprint, Boost Mobile, Cricket, MetroPCS, Virgin Mobile, and other major U.S. wireless carriers. Carrier participation and message delivery may vary.
7. Age Restriction (18+)
IMPORTANT — AGE REQUIREMENT:
Our website, services, and SMS messaging program are available only to individuals who are at least 18 years of age.
By submitting your information through our website forms, opting in to receive SMS text messages, or using any of our services, you represent and warrant that you are at least 18 years old.
If we discover or are notified that an individual under 18 years of age has submitted personal information or opted in to our SMS messaging program, we will immediately:
Delete all personal information associated with that individual from our records
Cancel their SMS enrollment and cease all messaging
Remove their data from our CRM system

8. Estimates and Pricing
All estimates provided by 360Epoxy are free, non-binding, and carry no obligation. Our minimum project investment starts at $1,999. Final pricing is determined after an on-site evaluation and mutual agreement on project scope, materials, timeline, and specifications. An estimate does not constitute a contract, agreement, or commitment to proceed with any project.
9. Intellectual Property
All content on this website, including but not limited to text, images, graphics, logos, the 360Epoxy brand name, the surfboard logo, and design elements, are the intellectual property of 360Epoxy and are protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written consent from 360Epoxy.
10. Limitation of Liability
To the fullest extent permitted by law, 360Epoxy and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of this website, our SMS messaging program, or our services. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you have paid to 360Epoxy for services in the 12 months preceding the claim.
11. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in the State of Utah.
12. Privacy Policy
Your use of our website and SMS messaging program is also governed by our Privacy Policy, which describes in detail how we collect, use, store, protect, and share (or do not share) your personal information, including your SMS opt-in consent data and mobile phone number. By agreeing to these Terms, you also acknowledge that you have read and understood our Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy shall prevail.
13. Changes to These Terms
We reserve the right to update, modify, or replace these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of our website, services, or SMS messaging program after changes are posted constitutes your acceptance of the revised Terms of Service.
